BUCKHEAD EXOTIC RENTALS LLC SUBSCRIPTION PROGRAM

IMPORTANT: PLEASE READ THESE TERMS OF USE CAREFULLY. THESE TERMS CONTAIN PROVISIONS THAT IMPACT YOUR RIGHTS AND OBLIGATIONS, INCLUDING AN ARBITRATION CLAUSE AND A CLASS ACTION WAIVER. BY SUBSCRIBING TO BUCKHEAD EXOTIC RENTALS’ PROGRAM, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, YOU MUST NOT SUBSCRIBE OR USE THIS SERVICE.

  1. About Us

1.1 Buckhead Exotic Rentals LLC (referred to as “Buckhead Exotic Rentals,” “we,” or “us”) offers a subscription program (“Service”) providing access to premium exotic and luxury vehicle rentals and chauffeur services across various cities, including but not limited to Atlanta (GA), Los Angeles (CA), New York City (NYC), Miami (FL), and Chicago (IL).

1.2 Monthly Subscription Fee: $1,000/month, subject to any applicable taxes.

1.3 Subscription Discount Benefits: This subscription provides up to a 50% discount on select rentals, including chauffeur services, with specific discounts varying by vehicle type and service. Not all vehicles or services may qualify for the full 50% discount, as rates differ depending on the rental or service selected.

1.4 Buckhead Exotic Rentals LLC does not require a traditional security deposit for approved subscription members unless otherwise stated in writing.

  1. Agreement to Terms

2.1 By subscribing to or using our Service, you agree to these Terms and any modifications we may make. Additional terms may apply to specific rentals, promotions, or vehicles, which will control if there is a conflict with these Terms.

2.2 Content and Availability: Buckhead Exotic Rentals LLC reserves the right to modify vehicle and chauffeur service availability based on city-specific demand, operational needs, maintenance requirements, scheduling, weather conditions, and other factors.

  1. Free Trials

3.1 Free trials, if offered, are subject to specific terms provided at sign-up. Unless canceled before the trial period expires, the subscription fee will automatically be billed to your payment method.

  1. Payment Terms

4.1 Authorized Payment Methods: We accept credit cards, debit cards, ACH transfers, and other approved payment methods. You represent that you have authority to use the provided payment method.

4.2 Billing and Payments: Subscription fees will be charged to your selected payment method on the subscription date. You authorize us to store your payment method and automatically bill your account each month until canceled.

4.3 Price Adjustments: Buckhead Exotic Rentals LLC reserves the right to change subscription fees or membership benefits. Notice of such changes will be provided at least 30 days before implementation.

4.4 Payment Default: Failure to make timely payments may result in suspension or termination of Service. Buckhead Exotic Rentals LLC reserves the right to pursue outstanding balances owed.

4.5 By subscribing, you authorize Buckhead Exotic Rentals LLC to charge any valid payment method on file for:
• Subscription fees
• Rental charges
• Fuel fees
• Smoking fees
• Mileage overages
• Damages
• Toll violations
• Traffic citations
• Cleaning fees
• Administrative fees
• Loss-of-use charges
• Late fees
• Collection costs
• Any unpaid balances owed under these Terms or any rental agreement

  1. Subscription Term, Renewal, and Termination

5.1 Term and Renewal: Subscriptions automatically renew each month unless canceled in accordance with these Terms.

5.2 Cancellation by Subscriber: Subscribers may cancel at any time before the next billing cycle. Cancellation becomes effective at the end of the current billing period.

5.3 Early Termination: If you terminate the subscription before the end of a billing period, or if we terminate for cause due to a breach of these Terms, no portion of the subscription fee will be refunded.

  1. Age Requirement

6.1 Subscribers must be at least 18 years old or the age of majority in their jurisdiction to subscribe to and use the Service.

6.2 Certain vehicles may require drivers to be 25 years old or older.

  1. Insurance Requirements

7.1 Subscribers must maintain valid full coverage automobile insurance acceptable to Buckhead Exotic Rentals LLC.

7.2 Insurance must include liability, collision, and comprehensive coverage.

7.3 Insurance must be valid for exotic, luxury, or specialty vehicles where applicable.

7.4 If insurance becomes invalid, denied, canceled, or insufficient, Buckhead Exotic Rentals LLC may deny or terminate vehicle access immediately.

  1. Vehicle Responsibility & Damages

8.1 Subscribers are fully responsible for any damage, theft, diminished value, mechanical abuse, cosmetic damage, wheel damage, tire damage, glass damage, vandalism, negligence, or misuse occurring during possession or operation of the vehicle regardless of fault.

8.2 Damage claims may be processed through the subscriber’s insurance policy or any valid payment method on file.

8.3 Subscribers may be responsible for:
• Repair costs
• Diminished value
• Administrative fees
• Towing and storage
• Recovery expenses
• Loss-of-use damages
• Collection costs
• Legal fees where permitted

  1. Fuel Policy

9.1 Vehicles must be returned with the same fuel level provided at delivery unless otherwise agreed in writing.

9.2 Failure to return the vehicle with the required fuel level may result in a $100 fuel service fee plus applicable refueling costs.

  1. Smoking Policy

10.1 All vehicles are strictly non-smoking.

10.2 Smoking includes cigarettes, cigars, marijuana, vapes, e-cigarettes, hookah, smoke residue, odor, ash, or burn marks.

10.3 Evidence of smoking will result in a minimum $1,000 smoking violation fee plus any applicable detailing, repair, odor-removal, or loss-of-use charges.

  1. Mileage Limitations

11.1 Mileage restrictions may apply depending on the vehicle selected.

11.2 Mileage overages must be paid immediately upon vehicle return.

11.3 Mileage overages may be charged to any valid payment method on file.

  1. Tolls, Tickets & Administrative Fees

12.1 All tolls, parking tickets, speeding tickets, red-light camera violations, towing charges, impound fees, and related violations are the subscriber’s responsibility.

12.2 Buckhead Exotic Rentals LLC may charge an administrative processing fee of up to $250 per violation in addition to the original amount owed.

  1. Authorized Drivers

13.1 Only approved drivers authorized in writing by Buckhead Exotic Rentals LLC may operate subscription vehicles.

13.2 Unauthorized drivers may void insurance coverage and result in termination of membership privileges.

  1. Prohibited Use

14.1 Prohibited use includes but is not limited to:
• Racing
• Track driving
• Burnouts
• Drifting
• Donuts
• Launch control abuse
• Reckless driving
• Illegal activity
• Commercial rideshare use
• Commercial filming without approval
• Driving under the influence
• Unauthorized out-of-state travel
• Unsafe or abusive operation

14.2 Violation may result in immediate termination of membership and vehicle recovery.

  1. Wheel, Tire & Undercarriage Damage

15.1 Subscribers are fully responsible for any wheel, rim, tire, splitter, suspension, undercarriage, or alignment damage occurring during the rental period regardless of fault.

  1. Cleaning & Excessive Filth

16.1 Vehicles returned excessively dirty may incur detailing and cleaning charges starting at $250.

16.2 This includes excessive trash, stains, sand, glitter, pet hair, smoke residue, food waste, spills, mud, bodily fluids, vomit, or abnormal interior or exterior dirtiness.

  1. Vehicle Monitoring & GPS

17.1 Vehicles may contain GPS systems, telematics, speed monitoring, cameras, and tracking systems for safety, theft prevention, and compliance purposes.

17.2 Tampering with monitoring systems is strictly prohibited.

  1. Vehicle Recovery & Late Returns

18.1 Unauthorized late returns may result in additional charges up to two (2) times the standard daily rental rate.

18.2 Buckhead Exotic Rentals LLC may disable, locate, recover, or repossess the vehicle where legally permitted.

  1. Limitation of Liability

19.1 Maximum Liability: Our liability to you for damages arising from your use of the Service is limited to the total amount you paid in subscription fees in the twelve (12) months preceding the claim.

19.2 Buckhead Exotic Rentals LLC shall not be liable for indirect, incidental, special, punitive, or consequential damages.

  1. Arbitration and Class Action Waiver

20.1 Dispute Resolution: Any disputes arising from or related to these Terms, including their interpretation and enforceability, will be resolved through binding arbitration.

20.2 Class Action Waiver: You and Buckhead Exotic Rentals LLC agree that all claims will be resolved on an individual basis only.

  1. Governing Law

21.1 These Terms shall be governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

  1. Arbitration Agreement

22.1 Any claim or dispute arising out of or relating to these Terms, your subscription, or your use of the Service will be resolved exclusively through binding arbitration administered by the National Arbitration and Mediation (NAM).

22.2 Arbitration proceedings may be conducted remotely by telephone or video unless otherwise agreed.

22.3 Arbitration proceedings and related information shall remain confidential.

  1. No Refund Policy

23.1 All payments are non-refundable.

23.2 If your subscription is canceled or terminated for cause, you will not be entitled to a refund for any unused portion of the subscription.

  1. Fraud Prevention & Verification

24.1 Buckhead Exotic Rentals LLC reserves the right to deny, suspend, terminate, or recover any vehicle due to suspected fraud, identity concerns, payment verification issues, suspicious activity, chargeback risk, or safety concerns.
